Casus jest następujący:
Craig wishes to arrange a Xmas party for his firm 'Naivety and Inefficiency'
on the 21st December and contacts Roguish Restaurants to arrange to book
them as a venue for the evening. His initial contact is with Andrew who he
meets whilst dining at the restaurant on the 10th October 2002. Craig is
told a provisional booking has been made and is given a list of possible
party options with prices for each option. They agree a minimum price for
the hire of the restaurant of ?1,000 Andrew confirms there is no need to
contact him until a week before to confirm the numbers and also which of the
party options would be appropriate and gives him his e-mail address.
On the 10th November Craig e-mails Andrew indicating that he wishes to
change the date of the party to the 14th December. He receives no response
to this e-mail nor any indication that the e-mail has not been delivered. In
the following week he writes a further e-mail stating 'in relation to party
in December we would like to choose option B on the menu and some 100 people
are expected. Please let me know about payment of any deposits required.'
Andrew acknowledges this e-mail on the 11th November and confirms 'deposit
of 10% required 24 hours before the event.'
On the 10th December Craig calls in Roguish Restaurants to pay the required
deposit. He is told that he has no reservation for the 14th but they have a
booking for the 21st as agreed. When Craig protests and refers to his
e-mail, Andrew replies that he had no e-mail from him about the change of
date. Craig is furious, as he cannot change the date of the party to 21st as
the board of the company will be abroad on that date. Andrew says it's
impossible to change the booking now to the 14th December as they are
already fully booked on that date.
Craig finds it very difficult at this late date to find an alternative
venue, the only place available being 'Shoddy and Nasty' a new restaurant
which is free that weekend. He therefore books there and pays them a deposit
of 10% in the sum of ?150. They agree to prepare some food and also a
certain amount of free drink for the party.
When the guests arrive on the 14th they wait for one hour for the food to
arrive as there are insufficient waiters employed. In addition the food is
cold and guests comment on the unusual taste of the meal. The waiter replies
that it is a speciality of the house and very popular.
Craig pays the balance required of ?1,350 on arrival at the restaurant
The next day 50 of the guests are taken to hospital seriously ill with food
poisoning. Naivety and Inefficiency was involved in a large contract which
they were completing in the following week and are now unable to deal with
everything on time due to the absence of so many staff. They are obliged to
pay a penalty of 20% on the contract price in the sum of ?10,000
Advise Craig and Naivety and Inefficiency.
Chodzi mi głównie o to jakie casy wykorzystać - małą poradę w kilku
zdaniach, jakiś taki mały szkic rozwiązania. Z góry dziękuję! Możesz
przesłać mi ewentualną odpowiedź także na maila.
